Cerebral Palsy

Pursuing Justice When Cerebral Palsy Results From Birth Injuries

Doctors might try to tell parents that their child's cerebral palsy was caused by unavoidable factors such as an infection in the womb, defective brain development or other genetic abnormalities. In many instances, this is true. But sometimes the doctor's own negligent actions may have actually caused cerebral palsy.

At the New York law office of Trolman, Glaser & Lichtman, P.C., our birth injury attorneys represent parents whose children were injured due to delivery-related malpractice. To schedule a free consultation to learn more about how we might be able to help you if your child has been diagnosed with cerebral palsy, contact us online or call us at 212-750-1200 or 1.888.4.TGLLAW.

Negligent Medical Treatment During Birth Can Cause Cerebral Palsy

If a baby's brain is deprived of oxygen during birth, permanent disability related to movement and coordination can occur. When a doctor fails to recognize fetal distress or fails to order a timely C-section, the child can suffer irreversible brain damage. Negligent use of forceps or vacuum extraction can also lead to brain damage.

When areas of the brain that control movement and muscle tone are damaged, cerebral palsy can result. Cerebral palsy often causes a child's muscles to be too stiff or too loose. It can affect a child's ability to walk and maintain balance. Children with cerebral palsy may also have other neurological disorders, including mental retardation or seizure disorders.

Errors causing brain damage in babies can occur at almost any time during pregnancy, labor or delivery. When an obstetrician, gynecologist or other health care provider fails to follow the appropriate standard of care and your child is injured and sustains brain damage or cerebral palsy as a result, accountability and compensation is required.

At Trolman, Glaser & Lichtman, our cerebral palsy lawyers know the law and have the medical resources to determine the cause of your child's injury and brain damage. If we determine that negligence caused the injury, we will start a lawsuit and pursue compensation for you and your child.

Most recently, a neurologically impaired infant fund was created in the state of New York to pay for future medical costs in birth-related neurological injury lawsuits. The fund covers all future medical costs, including hospital and doctor bills, medications, medical equipment, and home and vehicle modifications.
