Erb's Palsy

Representing the New York Families of Children Injured During Birth

When your child has been diagnosed with neurological injury to the nerves in the area of the neck, often times called Erb's palsy, you probably have more questions than answers. What are the long-term effects of Erb's palsy? How will it affect your child's quality of life? How could this have happened?

Understanding How Negligence Causes Erb's Palsy

Erb's palsy, a form of nerve damage and paralysis, is frequently caused by shoulder dystocia. Shoulder dystocia is a complication that arises during childbirth when there is difficulty delivering the baby's shoulders through the birth canal.

Obstetricians, gynecologists and other health care providers are trained to recognize warning signs and take appropriate steps to handle the complication. In many cases, doctors can predict the possibility of shoulder dystocia due to the large size of the fetus and can avoid this complication by delivering early or by cesarean section. Doctors can also take other steps during delivery to minimize the likelihood of nerve damage.

As with cerebral palsy, some doctors will tell parents that their child's Erb's palsy was caused by genetic defects. But that is rarely the case. Medical professionals who fail to take appropriate steps to avoid or respond to shoulder dystocia during delivery can be held legally accountable for the consequences of Erb's palsy.
